01. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you ("you" or "user") and Martinez Bros Landscape & Maintenance LLC, operating as the Spokane, WA branch ("Martinez Bros Spokane," "we," "us," or "our"), governing your use of the contact and free estimate request form ("Form") on this site.
By submitting the Form, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not submit the Form.
02. Who We Are
Martinez Bros Spokane is the Spokane, WA branch of Martinez Bros Landscape & Maintenance LLC, a family-owned landscaping business. This branch is independently managed and serves Spokane and the Inland Northwest.

Martinez Bros Landscape also operates an independently managed branch in the Coachella Valley, CA, which handles its own inquiries under its own terms.
03. Eligibility
You must be at least 18 years old to submit the Form on this site. By submitting the Form, you represent and warrant that you are 18 or older and that you have the legal authority to request services for the property or project described in your submission (e.g., you are the property owner, tenant, or an authorized representative).
04. The Form on This Site
This site offers a Free Estimate Request form, allowing you to reach out about a landscaping project and request a free, no-obligation estimate from Martinez Bros Spokane.
A hidden anti-spam ("honeypot") field is included in the form to help block automated bot submissions; it is not visible to human users and collects no information about you.
05. Information We Collect
When you submit the Form, we collect the information you voluntarily provide, which may include:
We do not knowingly collect information from anyone under 18, and the Form should not be submitted by or on behalf of a minor.
06. How We Use Your Information
We use the information submitted through the Form solely to:
- Respond to your inquiry and provide a free estimate or quote;
- Contact you by phone, text, or email to discuss your project, schedule a site visit, or follow up on a submitted request;
- Maintain internal records of inquiries and estimates for our business operations;
- Improve our site and services and detect/prevent spam or fraudulent submissions.
We do not sell your personal information to third parties. We do not use the information you submit for any purpose unrelated to responding to your inquiry, providing requested services, or (if you separately opt in) sending occasional service-related updates.
07. Phone, Text & Email Consent
By providing your phone number on the Form, you expressly consent to be contacted by Martinez Bros Spokane by phone call and text message (SMS), including from an automatic telephone dialing system or using pre-recorded/artificial voice technology where applicable, regarding your inquiry, estimate, or scheduled services.
- Message and data rates may apply, depending on your mobile carrier and plan.
- Message frequency will vary based on your inquiry and any ongoing project communication.
- Consent to receive texts or calls is not a condition of receiving any service or estimate.
- You may opt out of text messages at any time by replying STOP to any text, or opt out of calls/texts generally by contacting us using the information in Section 21.
- By providing your email address, you consent to receive email communications related to your inquiry. You may unsubscribe from any non-essential email communications at any time.
08. Third-Party Service Providers
We use third-party service providers to operate the Form and manage business communications, including:
- A third-party form processing service (currently Web3Forms) used to securely transmit form submissions from the site to our email inbox and to filter spam;
- Standard business tools such as email providers, customer relationship management (CRM) software, and scheduling tools, which may be used to store and organize your inquiry once received.
These providers process your information on our behalf and are only permitted to use it to provide these services to us. We do not control, and are not responsible for, the independent privacy practices of third-party providers; we encourage you to review their own privacy policies if you have concerns.
09. Estimates Are Not Binding Contracts
Submitting the Form, and any estimate, quote, price range, or scheduling information we provide in response, is an inquiry and informational exchange only. It does not create a binding contract, guaranteed price, or guaranteed appointment between you and Martinez Bros Spokane.
A binding agreement for services is only formed when both parties enter into a separate, formal agreement (written or otherwise mutually confirmed) specifying the scope of work, pricing, and schedule. Estimates given by phone, text, email, or in person following a form submission are preliminary and subject to change based on an in-person assessment of the property and project.
10. Accuracy of Your Submission
You are responsible for the accuracy of the information you submit. Providing false, misleading, or incomplete information (including an incorrect phone number, email, or property address) may delay or prevent our ability to respond to your inquiry, and any estimate provided in reliance on inaccurate information may not be honored.
11. Acceptable Use
When using the Form, you agree not to:
- Submit false, fraudulent, abusive, or harassing content;
- Impersonate another person or misrepresent your affiliation with any person or property;
- Attempt to bypass, disable, or interfere with the honeypot/anti-spam mechanism or otherwise submit automated or bulk form entries;
- Use the Form to transmit malware, unsolicited advertising, or unlawful content;
- Attempt to gain unauthorized access to our systems or the data of other users through the Form.
We reserve the right to disregard, delete, or decline to respond to any submission that violates this section.
12. Data Retention & Security
We retain form submission data for as long as reasonably necessary to respond to your inquiry, provide any requested services, and maintain business records, after which it may be deleted or archived. We use reasonable administrative and technical safeguards to protect the information you submit; however, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
13. Your Choices & Rights
You may, at any time:
- Request access to, correction of, or deletion of the personal information you submitted through the Form;
- Withdraw consent to be contacted by phone, text, or email as described in Section 7;
- Ask us not to share your information with a specific third-party provider going forward, where reasonably practicable.
To exercise any of these choices, contact us using the details in Section 21.
14. Intellectual Property
All content on this site — including text, graphics, logos, photos, and design — is owned by or licensed to Martinez Bros Landscape & Maintenance LLC and is protected by applicable intellectual property laws. Submitting the Form does not grant you any rights to our site content, and nothing on the site should be reproduced or used commercially without our prior written permission.
15. Disclaimer of Warranties
This site and the Form are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Form will be uninterrupted, error-free, or that any submission will be received or responded to within a particular time frame.
16. Limitation of Liability
To the fullest extent permitted by law, Martinez Bros Landscape & Maintenance LLC and its Spokane branch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Form or site, including any delay, failure, or error in transmitting or responding to a form submission, even if advised of the possibility of such damages. Our total liability arising from your use of the Form shall not exceed one hundred dollars ($100).
This limitation does not apply where prohibited by law, and nothing here limits liability that cannot be limited under applicable law.
17. Indemnification
You agree to indemnify and hold harmless Martinez Bros Landscape & Maintenance LLC, its owners, employees, and the Spokane branch from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Form, your violation of these Terms, or your submission of false or fraudulent information.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. The exclusive venue for any dispute arising from these Terms or your use of the Form shall be the state or federal courts located in Spokane County, Washington. These Terms do not require binding arbitration.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in our form, services, or legal requirements. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Form after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
20. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Martinez Bros Spokane regarding use of the Form and supersede any prior understandings regarding that subject.
